The doctor carries out a face-to-face assessment of the person under the Mental Capacity Act, looking at whether they can understand, retain, weigh and communicate a decision, and whether any impairment of the mind or brain affects that. The assessment is decision-specific, for example about property and finances or about personal welfare, and the COP3 form is completed afterwards.
This is a longer assessment and may need a home visit if the person cannot attend the clinic. The law assumes a person has capacity unless it is established otherwise, and the doctor documents the assessment carefully on that basis.
